Ser ou Estar? Reflexões sobre a Concessão de Direitos Políticos em Âmbito Municipal a Imigrantes no Brasil

The objective of this present article is to analyze the question regarding the extension of Political Rights to resident immigrants at the municipal level, given the current total prohibition on the active and passive electoral capacity of non- nationals. Through bibliographic and legislative research, the aim is to elucidate the dynamics of human mobility by differentiating the existing migratory categories in Brazil so that the concepts of nationality and citizenship are better understood. Finally, the unprecedented local experiences are analyzed, concluding by the necessity of alterations in the constitutional text that will confer to the resident immigrant a greater range of political rights, due to the evident mismatch compared to South American countries.
