The constitutional principle of access to justice is a fundamental right provided in item XXXV of Article 5 of the Brazilian Federal Constitution of 1988. This right guarantees all Brazilians the possibility of access to the Judiciary and Justice. However, reality shows that there are a number of obstacles to the realization of the right of access to justice, which prevents many Brazilian citizens from asserting their rights through judicial protection. It is necessary, therefore, to identify the sources of the problem, in order to think of effective and concrete solutions that can make the path of access to justice less tortuous.
