UM ESTUDO ACERCA DA RELAÇÃO CHINA – COREIA E DO PRINCÍPIO DO “NON-REFOULEMENT”

The present research deals with the grave situation of violation of human rights in North Korea, and one of its the main outcomes: the flee of many North Korea’s citizens to China. However, China usually repatriate the North Koreans to their home country, breaching the principle of non-refoulement. It is analyzed the jus cogens nature of that principle, the China- Korea ties – as an attempt to better comprehend the Chinese policy to repatriate North Korean refugees –, the United Nations Human Rights Council Resolution 34/24 (2017), in addition of specific doctrine.
