This paper seeks to identify a strategy of action that allows the State to perform its role the promoter of Human Rights in the context of demands for social legitimacy to new affective possibilities. The method of approach was deductive, used to research texts of law and doctrine. The paper concludes that, towards the requirements that mark postmodernity, it’s imperative that Law finds in flexibility and respect for self-determination a way to stay relevant.
