Indigenous communities in Colombia achieved constitutional recognition of their own Special Indigenous Jurisdiction, which allow them to determine prohibited behaviors, to stablish procedures of judicial sanctions and to impose sanctions to their members according to each community’s uses and social practices. This jurisdiction has had a significant case-law development led by Colombian Constitutional Court. Nonetheless, it still faces serious and constant challenges to its implementations, especially with regard to the human rights of indigenous people deprived of liberty.
