O presente ensaio busca lançar algumas reflexões sobre a figura da prisão, seja como estabelecimento de confinamento e segregação, seja como ato jurídico, e relacioná- la ao mecanismo de combate ao suplício físico direcionado ao preso, concluindo que se um lado a instituição da prisão visava a reduzir as práticas de tortura, por outro a prática cotidiana demonstrou que o hábito de violação de direitos básicos e fundamentais do indivíduo preso continua a existir.
